I, Dale Christopher Sicily, of 75 Maud Street, Fairfield West, NSW, born 6 March 1957, affirm and
state as

follows:
I am a friend of both the accused, Kenneth McManus, and the complainant, Kayleen
McManus. | have known them for several years, and we have socialised together on many
occasions.
Kenneth and Kayleen are siblings. Their mother gave them the property at 51 Margaret
Street, Fairfield West NSW 2165. Kenneth regularly visits and maintains the property.
Kenneth lived at this address with his mother until she moved into a nursing home. After
their mother moved, Kenneth invited Kayleen to live at the property to help them both save
on rent.
On 26 August 2025, | spent time with Kenneth and Kayleen at 85 Malabar Street, Canley Vale,
NSW 2166. The three of us drank beer together. There were no arguments or issues that |
observed during this time.
Later that day, Kayleen called me and asked me to come and pick up Kenneth up from 51
Margaret Street, Fairfield West NSW 2166. | went to the house with my friend Tanya, who
remained in the front passenger seat of my car when we arrived.
When | arrived, | parked my car and left the passenger side door open. | got out to see both
Kenneth and Kayleen, who were outside the house.
Both Kenneth and Kayleen approached my car. During this time, Kayleen pushed Kenneth
towards the car, and Kenneth ended up inside the passenger seat.
Tanya, who was still in the car, held Kenneth to prevent him from getting out again. | then
got into the driver’s seat and prepared to leave.

9. Atno time did | see Kenneth act aggressively towards Kayleen or strike her with any object,
including a bat.
10. There was a struggle between Kenneth and Kayleen over the bat, but | cannot specifically say
who grabbed it first as both had their hands on it at one point. Everything happened very
quickly.
11. | observed Kayleen holding the bat during the incident. | also saw Kayleen hitting Kenneth
with the bat on his hands as he tried to shield himself from further strikes.
12. Kenneth used his hands and arms to protect his face and head. He did not retaliate or strike
Kayleen with the bat.
13. Kenneth did not hit Kayleen with the bat at any time while | was present. If he had, | believe
the injuries would have been much more serious than what has been claimed.
14. During the struggle, Kayleen eventually took the bat and ran away. | did not see any blood or
visible injuries on Kayleen’s head or hands at any time while | was there.
15. | did not see any injuries on Kayleen during or after the incident. She did not complain of pain
or show any signs of being hurt while | was present.
16. | cannot say how Kayleen got the injuries she later claimed. As far as | saw, Kenneth did not
cause her any harm.
17. | did not see any blood or injury on Kenneth’s hands or face, but | did see him using his hands
to protect himself from being hit by Kayleen.
18. Earlier in the evening, there was a moment when Kayleen hugged Kenneth tightly. Kenneth
has a sore back and neck, which Kayleen was not aware of. Kenneth tried to use his hands to
create space and reduce the pain from the hug, not to harm Kayleen.
19. At no time did Kenneth grab Kayleen by the neck or act in a way that could be considered
assault.
20. | did not participate in the hug, as | was aware of Kenneth’s back and neck issues and gave
them space.
21. Based on what | saw, Kayleen was the aggressor during the incident. Kenneth acted only to
defend himself and did not assault Kayleen.
22. | am providing this affidavit to give a truthful account of what | witnessed on 26 August 2025.

| am the defendant in these proceedings. | provide this statement to give a truthful and
complete account of the events that occurred on 26 August 2025 involving my sister,
Kayleen McManus.
| am 65 years of age. | am charged with one count of assault occasioning actual bodily harm.
On the morning of 26 August 2025, my sister attended my residence at 85 Malabar Street,
Canley Vale. During the morning, we consumed alcohol together.
During the course of that morning a verbal argument developed between us regarding
family matters. Although the discussion became heated, there was no physical
contact between us at that time.
My sister contacted police. Police attended the premises and spoke with both of us. After
speaking with us, police transported my sister to her residence at 51 Margaret Street,
Fairfield West. | remained at my residence.
Ambulance officers attended and assessed me shortly afterwards. | was informed that | did
not require hospitalisation.
Later that same evening, at approximately 6:45 pm, | walked to 51 Margaret Street, Fairfield
West. My purpose in attending that address was to retrieve personal belongings from the
granny flat located on the property, which | regularly use and where | keep some of my
possessions.
| did not attend the premises intending to confront my sister or to continue any argument
with her.
Shortly after | arrived, Mr Dale Sicily attended the premises in his truck accompanied by his
partner, Tanya. Tanya remained seated in the front passenger seat of the vehicle and the
passenger side door remained open.
At this time my sister and | attempted to reconcile our earlier disagreement. We approached
each other and embraced.
During the embrace my sister held me tightly around my upper body. At the time | was
experiencing soreness in my back and neck. | had not previously mentioned this to my sister
and she was not aware of it.

12. The pressure from the embrace caused me pain. In response, I placed my hands on her
shoulders and attempted to move her away slightly in order to create some space. I did not
grab her by the neck and I did not act aggressively towards her.
13. Shortly afterwards I moved towards the passenger side of Mr Sicily`s truck.
14. As I did so, I observed my sister walk towards the driver`s side of the vehicle and reach inside
the cabin.
15. I then saw her remove a wooden baseball bat from inside the truck. I later became aware
that the bat belonged to Mr Sicily.
16. I had not seen the bat prior to that moment and I had not brought any weapon with me to
the premises.
17. When I saw my sister holding the bat I became concerned for my safety.
18. I approached her and a struggle occurred between us over control of the bat. During this
struggle both of us had our hands on the bat at the same time.
19. The incident happened very quickly. My actions were directed solely towards preventing my
sister from using the bat against me.
20. At no stage did I take sole possession of the bat from my sister.
21. During the struggle my sister struck me several times with the bat. The blows were directed
towards my hands and arms as I raised them to protect my head and face.
22. As a result, I experienced pain in my hands and arms.
23. I did not strike my sister with the bat at any time. I did not swing the bat towards her head
or any other part of her body.
24. My actions throughout the incident were limited to attempting to prevent my sister from
striking me and protecting myself from being injured.
25. I was fearful that I might be struck on the head if I did not protect myself.
26. At some stage during the struggle my sister retained possession of the bat and ran from the
vehicle into the house.
27. I did not pursue her. I remained near the vehicle.
28. While I was present, I did not observe any blood or visible injury to my sister. She did not
complain to me that she had been injured.
29. I observed that my own hands were sore and swollen after being struck with the bat.
30. I did not seek medical treatment at that time.
31. I later became aware that it had been alleged that I struck my sister with the bat. That
allegation is not true.
32. I did not strike my sister with the bat at any time.
33. I did not assault my sister.

Reasons for making this application and the duration sought:
The applicant is seeking an apprehended domestic violence order for a period of: 2 Years
The reasons the applicant is making an application for an apprehended domestic violence
order and seeks the period specified above are as follows
The defendant in the matter is Kenneth MCMANUS, born 7th of May 1960
The PINOP in the matter is Kayleen MCMANUS.
The PINOP and the defendant are brother and sister. The defendant resides at 85 Malabar
Street Canley Vale with 2 roommates being Dale Sicily and Tanya herein referred to as the
witness` in the matter.
The PINOP resides at 51 Margaret Street Fairfield West with her 2 daughters aged 17 and
29. The defendant would occasionally attend to the granny flat located at the rear of 51
Margaret Street Fairfield West.
On Tuesday the 26th of August 2025 at 10.00am, the defendant and PINOP were at 85
Malabar Street Canley Vale, where they consumed alcohol beverages. During this time the
PINOP brought up issues relating to their family. Due to their level of intoxication the PINOP
became highly emotional and the defendant becoming angry causing a heated verbal
argument.
As a result, the PINOP contacted police assistance line requesting police as the defendant
was unstable and aggressive.
Police arrived a short time later and mediated the situation by conveying the PINOP back to
residential address being 51 Margaret Street Fairfield West. The PINOP was left in the care
of both her daughters. NSW Ambulance attended a short time later and assessed the
defendant to where it was determined that he was not required to attend hospital.
At about 6.45pm on the same day, the PINOP was at her residence to where she observed
a noise coming from the garage. The PINOP walked over to the garage and observed the
defendant trying to walk into the premise towards the rear granny flat.
Due to the earlier incident, the defendant and the PINOP engaged in another heated verbal
argument. The PINOP requested the defendant to leave multiple times to which he refused
to do so. As a result, the PINOP contacted the witness’ to take the defendant back home.
A short time later the witness` attended to the PINOPs address and attempted to usher the
defendant into the vehicle to which he refused.
The defendant walked towards the witness` vehicle and grabbed a wooden bat. The
defendant used the bat and smashed it twice along the PINOP`s head causing immediate

pain, bleeding and fears for her safety. In a manner of self-defence, the PINOP snatched the
bat from the defendant and hit him with it in attempts to get him away from her.
The witness eventually intervened and ushered the defendant into their vehicle before
leaving the location.
The PINOP`s daughters came outside the premise after hearing the commotion and
observed the PINOP injured with blood along her hands and head. They also observed her
holding a wooden bat. As a result, the two daughters proceeded to contact Police and NSW
Ambulance.
NSW Ambulance and Police arrived a short time later where the PINOP was treated for her
injuries.
Police obtained a version from the PINOP on body worn video. The PINOP is willing to
provide a statement to police however due to her injuries she was required to be conveyed
to Liverpool hospital for further treatment. Police seized the wooden bat used in the incident
which was located in the PINOP`s bedroom.
The wooden bat was booked into NEXUS X0005538938 relates and forensic Job Lodged
72222 in attempts to identify blood.
The two (2) daughters attended Fairfield police station andprovided police with typed witness
statements.
About 10:20 am on Friday the 29th of August 2025 police attended SummitCare located
at11 Nyora Ave, Smithfield and activated body worn video. Police introduced themselves to
the defendant, cautioned him and placed him under arrest for assault. During the arrest the
defendant stated that the PINOP assaulted him.
The defendant was conveyed to Cabramatta Police Station where he was introduced to the
Custody Manager and explained his rights under Part 9 of the Law Enforcement (Powers
and Responsibilities) Act 2002.
Police conducted a forensic procedure on the defendant and collected his DNA via a buccal
swab R 0 927 321 relates.
The defendant was offered to partake in an electronically recordedinterview to which
disagreed.
Police applied for and were granted an Apprehended Domestic Violence Order listing the
defendant as the defendant and the PINOP along with her children as the Persons in Need
of Protection. This was served on the defendant whilst in police custody.
The defendant is now charged with the matter before the court.

The accused in the matter is Kenneth McMANUS, born 7th of May 1960
The victim in the matter is Kayleen MCMANUS.
The victim and the accused are brother and sister. The accused resides at 85 Malabar
Street Canley Vale with 2 roommates being Dale Sicily and Tanya Sicily herein referred to as
the witness` in the matter.
The victim resides at 51 Margaret Street Fairfield West with her 2 daughters aged 17 and 29.
The accused would occasionally attend to the granny flat located at the rear of 51 Margaret
Street Fairfield West.
On Tuesday the 26th of August 2025 at 10.00am, the accused and victim were at 85 Malabar
Street Canley Vale, where they consumed alcohol beverages. During this time the Victim
brought up issues relating to their family. Due to their level of intoxication the victim became
highly emotional and the accused becoming angry causing a heated verbal argument.
As a result, the victim contacted police assistance line requesting police as the accused was
unstable and aggressive.
Police arrived a short time later and mediated the situation by conveying the victim back to
residential address being 51 Margaret Street Fairfield West. The victim was left in the care of
both her daughters. NSW Ambulance attended a short time later and assessed the accused
to where it was determined that he was not required to attend hospital.
At about 6.45pm on the same day, the victim was at her residence to where she observed a

noise coming from the garage. The victim walked over to the garage and observed the
accused trying to walk into the premise towards the rear granny flat.
Due to the earlier incident, the accused and the victim engaged in another heated verbal
argument. The victim requested the accused to leave multiple times to which he refused to
do so. As a result, the victim contacted the witness` to take the accused back home.
A short time later the witness` attended to the victims address and attempted to usher the
accused into the vehicle to which he refused.
The accused walked towards the witness` vehicle and grabbed a wooden bat. The accused
used the bat and smashed it twice along the victim`s head causing immediate pain, bleeding
and fears for her safety. In a manner of self-defence, the victim snatched the bat from the
accused and hit him with it in attempts to get him away from her.
The witness eventually intervened and ushered the accused into their vehicle before leaving
the location.
The victim`s daughters came outside the premise after hearing the commotion and observed
the victim injured with blood along her hands and head. They also observed her holding a
wooden bat. As a result, the two daughters proceeded to contact Police and NSW
Ambulance.
NSW Ambulance and Police arrived a short time later where the victim was treated for her
injuries.
Police obtained a version from the victim on body worn video. The victim is willing to provide
a statement to police however due to her injuries she was required to be conveyed to
Liverpool hospital for further treatment. Police seized the wooden bat used in the incident
which was located in the victim`s bedroom.
The wooden bat was booked into NEXUS X000°538938 relates and forensic Job Lodged
72222 in attempts to identify blood.

The two (2) daughters attended Fairfield police station andprovided police with typed witness
statements.
About 10:20 am on Friday the 29th of August 2025 police attended SummitCare located atl 1
Nyora Ave, Smithfield and activated body worn video. Police introduced themselves to the
accused, cautioned him and placed him under arrest for assault. During the arrest the
accused stated that the victim assaulted him.
The accused was conveyed to Cabramatta Police Station where he was introduced to the
Custody Manager and explained his rights under Part 9 of the Law Enforcement (Powers and
Responsibilities) Act 2002.
Police conducted a forensic procedure on the accused and collected his DNA via a buccal
swab R 0 927 321 relates.
The accused was offered to partake in an electronically recorded interview to which
disagreed.
Police applied for and were granted an Apprehended Domestic Violence Order listing the
accused as the defendant and the victim along with her children as the Persons in Need of
Protection. This was served on the accused whilst in police custody.
The accused is now charged with the matter before the court.

7. At around 10.22pm on the same day, we arrived at 51 Margaret Street Fairfield with New South
Wales Ambulance, to where | walked up to the porch and observed a female hunched over a
table. | then proceeded to activate my police body worn video camera and identified the female
to be Kayleen MCMANUS.
8. During this time, | observed two females who | later identified to be Kaity and Rhiannon, to step
outside so that | can make relevant enquiries on what`s going on. | then observed Constable
SIMONIAN speak with both females making enquiries. During this time they informed me that
there Uncle Kenneth MCMANUS assaulted there mother being Kayleen Mc MANUS.

9. Whilst making the relevant enquiries both Kaity and Rhiannon, informed us that the bat used in
the assault was taken into the bedroom of the house. | then attended to the bedroom and to
where Kaity and Rhiannon, showed me the bat that was used. Both Constable SIMONIAN and
| observed the bat to be wooden with what we believed to be blood stains around it. We then
proceeded to seize the bat.

10. A short time later | was notified by NSW Paramedics that Kayleen McMANUS will need to

She said: “he showed up. He drunk off his face on Valium. | tried to talk calmly to him. | told
him to leave. He didn`t want to leave. Got into a verbal argument. He started to leave. | rang
his, the, like the person he lives with. Said, come and get him. So Dale and Tanya came and
picked him up. My brother started to get aggressive. He went into the car and I`m like, bro, |
only rang the police earlier with the ambulance to try and help you cause you need mental
health. And then he is grabbed a bat, smacked me over the back of the head, with it a couple
of times. | dragged the bat off him”
11. A short time later | then requested Kaity and Rhiannon to attend Fairfield police station to
obtain witness statements regarding on what happened, to which they agreed.
12. We then left the location and attended Fairfield police station.

15. At around 1.00am on Wednesday the 27` of August 2025, we attended 85 Malabar Street
Fairfield to arrest Kenneth William MCMANUS with no luck.
16. On Tuesday the 2` of September 2025, Kayleen McMANUS attended Fairfield Police station to
where she provided me with a typed statement and medical records/discharge summary of her
time at the hospital.

7. Constable DEO and | arrived at 51 Margaret St, Fairfield West at 10:20pm. We walked up on to
the porch, and | saw a female, who | now know to be the victim Kayleen McMANUS hunched
over on the chair. She was conscious and breathing. Subsequently, paramedics attended to
assess Kayleen before we spoke with her.
8. | then spoke with two females who | now know to be the daughters of Kayleen, Kaity and
Rhiannon.
| said — I`ll just let you know were from Fairfield Police, our cameras are on.

9. After speaking with Kaity and Rhiannon, they told us that a brown wooden bat was used in the
alleged assault. This was moved into one of the bedrooms inside the house. Constable DEO
and | walked into the residence and located the bat on the bed. There appeared to be some
red splatter on the bat which we believed may be blood. | seized this bat in an exhibit bag.
10. Whilst Kayleen was being assessed in the ambulance, Constable DEO and | had a brief
conversation with her before she was conveyed to hospital.
11. Kaity and Rhiannon agreed to attend Fairfield Police Station where | obtained witness
statements from both of them.

12. After obtaining the statements, I booked in the seized brown wooden bat into police Nexus system to be forensically examined.
13. About 1:00am, Constable DEO and I attended 85 Malabar St, Fairfield to arrest the accused however we were unsuccessful.
14. We returned to our duties for the remainder of the shift and advised Fairfield Internal Supervisor of the outstanding arrest.

necessary, to give in court as a witness. The statement is true to the best of my knowledge and

have wilfully stated in it anything that | know to be false, or do not believe to be true.
2. lam 55 years of age.
3. | have not used Generative Artificial Intelligence (Gen Al) in the creation of this statement or
any attached exhibits.
4. | currently reside at 51 Margaret Street Fairfield West with my 2 daughters being Kaity
ABSALOM and Rhianna ABSALOM. | reside at the front house and Kenneth MCMANUS being
my brother occasionally visits the rear granny flat.
5. Kenneth MCMANUS is my biological brother. My brother is diagnosed with paranoia,
schizophrenia and is described to be always aggressive and argumentative.
6. On Tuesday the 26` of August 2025 at around 4.00pm | was taken back to my home by police,
after drinking alcohol beverages with Kenneth MCMANUS at 85 Malabar Street Canley Vale.
7. | was then seated along my veranda at the front porch smoking a cigarette to where | heard the
front gate open. | then looked over the mesh and saw Kenneth MCMANUS walking towards the
garage door attempting to unlock it. During this time, | sat there quietly as | did not want to
converse with him or him to know | was there.

8. |then heard a loud smash on the garage door.
9. |then immediately proceeded to contact Dale SICILY being Kenneth’s roommate. Whilst on the
phone, | then walked towards the edge of the driveway and stood on the council footpath. | was
speaking to Dale SICILY and his partner Tanya saying:
| said: “Please hurry up, he’s going to turn, he is drunk again.”
They said: “stay on the phone, were on our way.”
10. A short time later | then saw their car pull up to the driveway. I`ve then seen Kenneth
MCMANUS walk towards the car. During this time Dale SICILY and Tanya got out of the
vehicle. Kenneth MCMANUS stumbled whilst walking to the car. | then tried to help him get up
immediately. He then used both his hands and grabbed me around the neck. | was having
slight trouble of breathing but was conscious the whole time. Dale SICILY and Tanya then
intervened and separated us both.
11. A short time later we had a group hug and tried to fix things. After having a group hug, Dale
SICILY walked away to have a smoke. During this time, Tanya opened the passenger door to
the truck and Told Kenneth come ‘on lets go.
12. A short time later | turned around to where | then was hit hard in the back of my head. | felt
immediate pain, shock and stumbled a bit. | then turned around and saw Kenneth MCMANUS
holding a wooden bat roughly 40-50cm in length.
13. I then tried to take the bat away from him by grabbing the bat directly and trying to yank it off
him. 1 was fearful that if | didn’t get that bat, he was going to kill me.
14. 1 then eventually took the bat off him and then took it straight inside the house. During this time
Dale SICILY and Tanya got Kenneth MCMANUS into the car and immediately drove away from
the location.
15. | then felt immediate pain and proceeded to call triple zero 000 requesting for police.
16. A short time later NSW Ambulance and NSW Police arrived and spoke to my daughters and |. |
was then taken to Liverpool hospital for treatment to my head.

17. Whilst at the hospital, the doctors clarified that there was bleeding, bruising and swelling around my head and hand.
18. On Tuesday the 2nd of September 2025, I attended Fairfield police station and provided police with a typed statement. I also provided police with medical records/discharge summary of my time at hospital.
19. I did not give anyone permission to hit me in the head. I have severe fears for my safety and the safety of my daughters and I believe Kenneth MCMANUS is violent and can cause us harm.

1) In the course of her assessment she had a CT Abdomen pelvis that reported a hypodense lesion in the pancreatic uncinate process, suspected
Intraductal Papillary Mucinous Neoplasm. In followup please ensure she has an MRI pancreas to clarify or exclude this diagnosis. She has been updated |
this concern today and understands the importance of completing this investigation, many thanks.
2) No CT demonstrated injuries, but review of pain relief, prescribed paracetamol and ibuprofen, with breakthrough 10 tablets of Smg Endone QID PRN
for severe pain particularly at night if required advised not to drive
3) Please support her social situation and her concerns re her brother`s mental health if he is also under your care

necessary, to give in court as a witness. The statement is true to the best of my knowledge and
belief and | make it knowing that, if it is tendered in evidence, | will be liable to prosecution if |

4. |live at 51 Margaret St, Fairfield West with my mother Kayleen McMANUS and my older sister
Rhiannon ABSALOM. We have lived there for about a year and a half.
5. | was at home all day because | didn`t go to school. The whole day, my mum was a bit off
about her brother Kenneth McManus who is my uncle. He always acts weird because of his
mental health issues. He always creates drama or does something to piss my mum off.
6. About 11am, my mum came into my room and told me that Dale who is my uncles roommate
was going to come over to discuss what will happen with my uncle because Dale wanted to
move houses. He didn’t want to take Kenny with him but he didn’t want to leave him here
because he didn’t want him to harass my mum, sister and |.

My mum said she was going to go to Dale’s house with him to try sort out something with my
uncle. My mum messaged me about 4:00pm and said ill be home soon and that the police had
been called. She didn`t really tell me much just that Rhiannon was coming home early.
| called Rhiannon and asked what happened and she said she had to go pick up mum.
About 4:50pm mum came home with Rhiannon. Mum was really emotional. She was hard to
talk to. She was crying a lot and wouldn’t calm down. Normally when shes upset | try to make
sure shes okay, so | was giving her water.
Around 7:00pm, we started to cook dinner and | heard my mum outside on the phone to
someone. | then heard Dales truck. His Truck has a sound that you just know its that truck
because its very loud. My mum then came in and said Kenny was here. She said he was in the
flat. We just stayed inside and mum said Dale called the police.
My mum went back outside. Me and Rhiannon stayed inside. We heard yelling so we looked
outside to see what happened. | heard my mum say, “You`re my brother, why are you doing
this”. Something along the lines of that. | could just hear Kenny swearing. Eventually | heard
the truck leave. It was quiet so | assumed Kenny left too.
My mum came inside, and she was holding a bat in her hand. It was about 50cm long, brown,
wooden. She was crying and said something along the lines of “He hit me in the head with a
bat”. | was a bit confused because my mum told me Dale called the police so | thought they
would be here by now.
| was trying to keep my mum calm and gave her water. Me and Rhiannon then called police
and ambulance again. | took photos of my mum’s hand. | saw blood on her left hand. | asked
her what happened, but she said she didn’t know what happened.
About an hour later she said the blood might have come from when she was trying to get the
bat out of his hand.
Police and paramedics arrived not long after that. | spoke with Constable DEO and Constable
SIMONIAN and agreed to meet them at Fairfield Police Station to provide a statement.

7. My mum told me that police and ambulance were called because Kenny was very erratic and
had weapons but didn’t hurt anyone, and that the police told her she couldn`t drive home.
8. | got home at around 5:15pm. By the time | got home my mum had been dropped home by the
police but we still needed to go get her car. We left my sister at home then | drove mum to
Kenny and Dale’s. When we arrived, the ambulance was already there. Kenny was in the
ambulance and Dale was on the phone. Mum and Dale briefly spoke, and Dale told mum that
they would take Kenny to the hospital. Me and mum then got into the car and drove home.
9. We got home, went about our normal routine and then Kaity and | were inside. Mum was on
the veranda. Probably about an hour and a half to two hours later, Kaity and | were having
dinner and that`s when we heard voices outside. Because Kenny is always there, we didn’t
engage but | recognised that it was his voice. | then heard Dale`s truck because its very
distinct. Its like a vintage truck so it has a very loud engine. | then heard Dale’s voice. | didn`t
hear any yelling but | just heard them talking outside. Roughly 5 to 10 minutes later, mum came
inside and said “He’s hit me with a fucken bat”.
10. Mum was holding a bat, about 30cm in length, dark brown, wood, thick, smooth with some
cracks in it. | didn’t recognise the bat. | don’t know where it came from, but Kenny does often
come over with weapons.
11.1 then asked if she was okay, and Kaity checked mums head to see if there was any bleeding
or cuts which there weren`t. | then heard the truck leave and mum told us that Dale and Tania,
which is Dale’s girlfriend witnessed what happened and had taken Kenny home.
12. | asked what happened, she told us that she confronted Kenny for being at the house and
asked why he was there. He was then mouthing off, | don’t know what he had said. Then that
turned into the altercation of him hitting her. My mum said she doesn`t recall how the scratches
on her hand happened, but she remembers trying to get the bat back and hit Kenny`s knuckles
to try get the bat off her.
13. My mum told us she had called police and that she declined ambulance at the time. My mum
kept saying she was feeling very sleepy. She was lent over the table with her head on her
hands for about half an hour. Kaity and | kept asking if she was awake and trying to get her to

15. When we moved to Maragret St, | raised some concerns with mum about Kenny. | have seen a
lot of violence from him. | told mum | was worried about our safety. | always wonder if he is
going to come in or try and break in or hurt mum because of previous incidents with Kenny and
my mum. My mum’s relationship has eased the concerns with Kenny however due to this
incident, these concerns are more real now.

I, Dale Christopher Sicily, of 75 Maud Street, Fairfield West, NSW, born 6 March 1957, affirm and
state as

I am a friend of both the accused, Kenneth McManus, and the complainant, Kayleen
McManus. | have known them for several years, and we have socialised together on many
occasions.
Kenneth and Kayleen are siblings. Their mother gave them the property at 51 Margaret
Street, Fairfield West NSW 2165. Kenneth regularly visits and maintains the property.
Kenneth lived at this address with his mother until she moved into a nursing home. After
their mother moved, Kenneth invited Kayleen to live at the property to help them both save
on rent.
On 26 August 2025, | spent time with Kenneth and Kayleen at 85 Malabar Street, Canley Vale,
NSW 2166. The three of us drank beer together. There were no arguments or issues that |
observed during this time.
Later that day, Kayleen called me and asked me to come and pick up Kenneth up from 51
Margaret Street, Fairfield West NSW 2166. | went to the house with my friend Tanya, who
remained in the front passenger seat of my car when we arrived.
When | arrived, | parked my car and left the passenger side door open. | got out to see both
Kenneth and Kayleen, who were outside the house.
Both Kenneth and Kayleen approached my car. During this time, Kayleen pushed Kenneth
towards the car, and Kenneth ended up inside the passenger seat.
Tanya, who was still in the car, held Kenneth to prevent him from getting out again. | then
got into the driver’s seat and prepared to leave.

9. Atno time did | see Kenneth act aggressively towards Kayleen or strike her with any object,
including a bat.
10. There was a struggle between Kenneth and Kayleen over the bat, but | cannot specifically say
who grabbed it first as both had their hands on it at one point. Everything happened very
quickly.
11. | observed Kayleen holding the bat during the incident. | also saw Kayleen hitting Kenneth
with the bat on his hands as he tried to shield himself from further strikes.
12. Kenneth used his hands and arms to protect his face and head. He did not retaliate or strike
Kayleen with the bat.
13. Kenneth did not hit Kayleen with the bat at any time while | was present. If he had, | believe
the injuries would have been much more serious than what has been claimed.
14. During the struggle, Kayleen eventually took the bat and ran away. | did not see any blood or
visible injuries on Kayleen’s head or hands at any time while | was there.
15. | did not see any injuries on Kayleen during or after the incident. She did not complain of pain

16. | cannot say how Kayleen got the injuries she later claimed. As far as | saw, Kenneth did not
cause her any harm.
17. | did not see any blood or injury on Kenneth’s hands or face, but | did see him using his hands
to protect himself from being hit by Kayleen.
18. Earlier in the evening, there was a moment when Kayleen hugged Kenneth tightly. Kenneth
has a sore back and neck, which Kayleen was not aware of. Kenneth tried to use his hands to
create space and reduce the pain from the hug, not to harm Kayleen.
19. At no time did Kenneth grab Kayleen by the neck or act in a way that could be considered
assault.

| am the defendant in these proceedings. | provide this statement to give a truthful and
complete account of the events that occurred on 26 August 2025 involving my sister,
Kayleen McManus.
| am 65 years of age. | am charged with one count of assault occasioning actual bodily harm.
On the morning of 26 August 2025, my sister attended my residence at 85 Malabar Street,
Canley Vale. During the morning, we consumed alcohol together.
During the course of that morning a verbal argument developed between us regarding
family matters. Although the discussion became heated, there was no physical
contact between us at that time.
My sister contacted police. Police attended the premises and spoke with both of us. After
speaking with us, police transported my sister to her residence at 51 Margaret Street,
Fairfield West. | remained at my residence.
Ambulance officers attended and assessed me shortly afterwards. | was informed that | did
not require hospitalisation.
Later that same evening, at approximately 6:45 pm, | walked to 51 Margaret Street, Fairfield
West. My purpose in attending that address was to retrieve personal belongings from the
granny flat located on the property, which | regularly use and where | keep some of my
possessions.
| did not attend the premises intending to confront my sister or to continue any argument
with her.
Shortly after | arrived, Mr Dale Sicily attended the premises in his truck accompanied by his
partner, Tanya. Tanya remained seated in the front passenger seat of the vehicle and the
passenger side door remained open.
At this time my sister and | attempted to reconcile our earlier disagreement. We approached
each other and embraced.
During the embrace my sister held me tightly around my upper body. At the time | was
experiencing soreness in my back and neck. | had not previously mentioned this to my sister
and she was not aware of it.

12. The pressure from the embrace caused me pain. In response, I placed my hands on her
shoulders and attempted to move her away slightly in order to create some space. I did not
grab her by the neck and I did not act aggressively towards her.
13. Shortly afterwards I moved towards the passenger side of Mr Sicily`s truck.
14. As I did so, I observed my sister walk towards the driver`s side of the vehicle and reach inside
the cabin.
15. I then saw her remove a wooden baseball bat from inside the truck. I later became aware
that the bat belonged to Mr Sicily.
16. I had not seen the bat prior to that moment and I had not brought any weapon with me to
the premises.
17. When I saw my sister holding the bat I became concerned for my safety.
18. I approached her and a struggle occurred between us over control of the bat. During this
struggle both of us had our hands on the bat at the same time.
19. The incident happened very quickly. My actions were directed solely towards preventing my
sister from using the bat against me.
20. At no stage did I take sole possession of the bat from my sister.
21. During the struggle my sister struck me several times with the bat. The blows were directed
towards my hands and arms as I raised them to protect my head and face.
22. As a result, I experienced pain in my hands and arms.
23. I did not strike my sister with the bat at any time. I did not swing the bat towards her head
or any other part of her body.
24. My actions throughout the incident were limited to attempting to prevent my sister from
striking me and protecting myself from being injured.
25. I was fearful that I might be struck on the head if I did not protect myself.
26. At some stage during the struggle my sister retained possession of the bat and ran from the
vehicle into the house.
27. I did not pursue her. I remained near the vehicle.
28. While I was present, I did not observe any blood or visible injury to my sister. She did not
complain to me that she had been injured.
29. I observed that my own hands were sore and swollen after being struck with the bat.
30. I did not seek medical treatment at that time.
31. I later became aware that it had been alleged that I struck my sister with the bat. That
allegation is not true.
32. I did not strike my sister with the bat at any time.
33. I did not assault my sister.

Reasons for making this application and the duration sought:
The applicant is seeking an apprehended domestic violence order for a period of: 2 Years
The reasons the applicant is making an application for an apprehended domestic violence
order and seeks the period specified above are as follows
The defendant in the matter is Kenneth MCMANUS, born 7th of May 1960
The PINOP in the matter is Kayleen MCMANUS.
The PINOP and the defendant are brother and sister. The defendant resides at 85 Malabar
Street Canley Vale with 2 roommates being Dale Sicily and Tanya herein referred to as the
witness` in the matter.
The PINOP resides at 51 Margaret Street Fairfield West with her 2 daughters aged 17 and
29. The defendant would occasionally attend to the granny flat located at the rear of 51
Margaret Street Fairfield West.
On Tuesday the 26th of August 2025 at 10.00am, the defendant and PINOP were at 85
Malabar Street Canley Vale, where they consumed alcohol beverages. During this time the
PINOP brought up issues relating to their family. Due to their level of intoxication the PINOP
became highly emotional and the defendant becoming angry causing a heated verbal
argument.
As a result, the PINOP contacted police assistance line requesting police as the defendant
was unstable and aggressive.
Police arrived a short time later and mediated the situation by conveying the PINOP back to
residential address being 51 Margaret Street Fairfield West. The PINOP was left in the care
of both her daughters. NSW Ambulance attended a short time later and assessed the
defendant to where it was determined that he was not required to attend hospital.
At about 6.45pm on the same day, the PINOP was at her residence to where she observed
a noise coming from the garage. The PINOP walked over to the garage and observed the
defendant trying to walk into the premise towards the rear granny flat.
Due to the earlier incident, the defendant and the PINOP engaged in another heated verbal
argument. The PINOP requested the defendant to leave multiple times to which he refused
to do so. As a result, the PINOP contacted the witness’ to take the defendant back home.
A short time later the witness` attended to the PINOPs address and attempted to usher the
defendant into the vehicle to which he refused.
The defendant walked towards the witness` vehicle and grabbed a wooden bat. The
defendant used the bat and smashed it twice along the PINOP`s head causing immediate

pain, bleeding and fears for her safety. In a manner of self-defence, the PINOP snatched the
bat from the defendant and hit him with it in attempts to get him away from her.
The witness eventually intervened and ushered the defendant into their vehicle before
leaving the location.
The PINOP`s daughters came outside the premise after hearing the commotion and
observed the PINOP injured with blood along her hands and head. They also observed her
holding a wooden bat. As a result, the two daughters proceeded to contact Police and NSW
Ambulance.
NSW Ambulance and Police arrived a short time later where the PINOP was treated for her
injuries.
Police obtained a version from the PINOP on body worn video. The PINOP is willing to
provide a statement to police however due to her injuries she was required to be conveyed
to Liverpool hospital for further treatment. Police seized the wooden bat used in the incident
which was located in the PINOP`s bedroom.
The wooden bat was booked into NEXUS X0005538938 relates and forensic Job Lodged
72222 in attempts to identify blood.
The two (2) daughters attended Fairfield police station andprovided police with typed witness
statements.
About 10:20 am on Friday the 29th of August 2025 police attended SummitCare located
at11 Nyora Ave, Smithfield and activated body worn video. Police introduced themselves to
the defendant, cautioned him and placed him under arrest for assault. During the arrest the
defendant stated that the PINOP assaulted him.
The defendant was conveyed to Cabramatta Police Station where he was introduced to the
Custody Manager and explained his rights under Part 9 of the Law Enforcement (Powers
and Responsibilities) Act 2002.
Police conducted a forensic procedure on the defendant and collected his DNA via a buccal
swab R 0 927 321 relates.
The defendant was offered to partake in an electronically recordedinterview to which
disagreed.
Police applied for and were granted an Apprehended Domestic Violence Order listing the
defendant as the defendant and the PINOP along with her children as the Persons in Need
of Protection. This was served on the defendant whilst in police custody.
The defendant is now charged with the matter before the court.

The accused male has a criminal history with Police and has been charged with matters of
violence, malicious damage, drugs and traffic matters with convictions recorded. The
accused has had one (1) warrant executed in 2010.
The accused is unemployed and has no dependants.
FULL FACTS
The accused in the matter is Kenneth McMANUS, born 7th of May 1960
The victim in the matter is Kayleen MCMANUS.
The victim and the accused are brother and sister. The accused resides at 85 Malabar
Street Canley Vale with 2 roommates being Dale Sicily and Tanya Sicily herein referred to as
the witness` in the matter.
The victim resides at 51 Margaret Street Fairfield West with her 2 daughters aged 17 and 29.
The accused would occasionally attend to the granny flat located at the rear of 51 Margaret
Street Fairfield West.
On Tuesday the 26th of August 2025 at 10.00am, the accused and victim were at 85 Malabar
Street Canley Vale, where they consumed alcohol beverages. During this time the Victim
brought up issues relating to their family. Due to their level of intoxication the victim became
highly emotional and the accused becoming angry causing a heated verbal argument.
As a result, the victim contacted police assistance line requesting police as the accused was
unstable and aggressive.
Police arrived a short time later and mediated the situation by conveying the victim back to
residential address being 51 Margaret Street Fairfield West. The victim was left in the care of
both her daughters. NSW Ambulance attended a short time later and assessed the accused
to where it was determined that he was not required to attend hospital.
At about 6.45pm on the same day, the victim was at her residence to where she observed a

noise coming from the garage. The victim walked over to the garage and observed the
accused trying to walk into the premise towards the rear granny flat.
Due to the earlier incident, the accused and the victim engaged in another heated verbal
argument. The victim requested the accused to leave multiple times to which he refused to
do so. As a result, the victim contacted the witness` to take the accused back home.
A short time later the witness` attended to the victims address and attempted to usher the
accused into the vehicle to which he refused.
The accused walked towards the witness` vehicle and grabbed a wooden bat. The accused
used the bat and smashed it twice along the victim`s head causing immediate pain, bleeding
and fears for her safety. In a manner of self-defence, the victim snatched the bat from the
accused and hit him with it in attempts to get him away from her.
The witness eventually intervened and ushered the accused into their vehicle before leaving
the location.
The victim`s daughters came outside the premise after hearing the commotion and observed
the victim injured with blood along her hands and head. They also observed her holding a
wooden bat. As a result, the two daughters proceeded to contact Police and NSW
Ambulance.
NSW Ambulance and Police arrived a short time later where the victim was treated for her
injuries.
Police obtained a version from the victim on body worn video. The victim is willing to provide
a statement to police however due to her injuries she was required to be conveyed to
Liverpool hospital for further treatment. Police seized the wooden bat used in the incident
which was located in the victim`s bedroom.
The wooden bat was booked into NEXUS X000°538938 relates and forensic Job Lodged
72222 in attempts to identify blood.

The two (2) daughters attended Fairfield police station andprovided police with typed witness
statements.
About 10:20 am on Friday the 29th of August 2025 police attended SummitCare located atl 1
Nyora Ave, Smithfield and activated body worn video. Police introduced themselves to the
accused, cautioned him and placed him under arrest for assault. During the arrest the
accused stated that the victim assaulted him.
The accused was conveyed to Cabramatta Police Station where he was introduced to the
Custody Manager and explained his rights under Part 9 of the Law Enforcement (Powers and
Responsibilities) Act 2002.
Police conducted a forensic procedure on the accused and collected his DNA via a buccal
swab R 0 927 321 relates.
The accused was offered to partake in an electronically recorded interview to which
disagreed.
Police applied for and were granted an Apprehended Domestic Violence Order listing the
accused as the defendant and the victim along with her children as the Persons in Need of
Protection. This was served on the accused whilst in police custody.
The accused is now charged with the matter before the court.

7. At around 10.22pm on the same day, we arrived at 51 Margaret Street Fairfield with New South
Wales Ambulance, to where | walked up to the porch and observed a female hunched over a
table. | then proceeded to activate my police body worn video camera and identified the female
to be Kayleen MCMANUS.
8. During this time, | observed two females who | later identified to be Kaity and Rhiannon, to step
outside so that | can make relevant enquiries on what`s going on. | then observed Constable
SIMONIAN speak with both females making enquiries. During this time they informed me that
there Uncle Kenneth MCMANUS assaulted there mother being Kayleen Mc MANUS.

9. Whilst making the relevant enquiries both Kaity and Rhiannon, informed us that the bat used in
the assault was taken into the bedroom of the house. | then attended to the bedroom and to
where Kaity and Rhiannon, showed me the bat that was used. Both Constable SIMONIAN and
| observed the bat to be wooden with what we believed to be blood stains around it. We then
proceeded to seize the bat.

10. A short time later | was notified by NSW Paramedics that Kayleen McMANUS will need to
attend hospital for slight bleeding and possible injuries to her hand and head. During this time |

McMANUS on was happened.

She said: “he showed up. He drunk off his face on Valium. | tried to talk calmly to him. | told
him to leave. He didn`t want to leave. Got into a verbal argument. He started to leave. | rang
his, the, like the person he lives with. Said, come and get him. So Dale and Tanya came and
picked him up. My brother started to get aggressive. He went into the car and I`m like, bro, |
only rang the police earlier with the ambulance to try and help you cause you need mental
health. And then he is grabbed a bat, smacked me over the back of the head, with it a couple
of times. | dragged the bat off him”
11. A short time later | then requested Kaity and Rhiannon to attend Fairfield police station to
obtain witness statements regarding on what happened, to which they agreed.
12. We then left the location and attended Fairfield police station.
13. | then tasked Constable SIMONIAN to obtain witness statements from both Kaity and
Rhiannon.

14. I`ve received the above statements from Constable SIMONIAN and proceeded to complete
relevant paperwork.
15. At around 1.00am on Wednesday the 27` of August 2025, we attended 85 Malabar Street
Fairfield to arrest Kenneth William MCMANUS with no luck.
16. On Tuesday the 2` of September 2025, Kayleen McMANUS attended Fairfield Police station to
where she provided me with a typed statement and medical records/discharge summary of her
time at the hospital.

7. Constable DEO and | arrived at 51 Margaret St, Fairfield West at 10:20pm. We walked up on to
the porch, and | saw a female, who | now know to be the victim Kayleen McMANUS hunched
over on the chair. She was conscious and breathing. Subsequently, paramedics attended to
assess Kayleen before we spoke with her.
8. | then spoke with two females who | now know to be the daughters of Kayleen, Kaity and
Rhiannon.
| said — I`ll just let you know were from Fairfield Police, our cameras are on.

9. After speaking with Kaity and Rhiannon, they told us that a brown wooden bat was used in the
alleged assault. This was moved into one of the bedrooms inside the house. Constable DEO
and | walked into the residence and located the bat on the bed. There appeared to be some
red splatter on the bat which we believed may be blood. | seized this bat in an exhibit bag.
10. Whilst Kayleen was being assessed in the ambulance, Constable DEO and | had a brief
conversation with her before she was conveyed to hospital.
11. Kaity and Rhiannon agreed to attend Fairfield Police Station where | obtained witness
statements from both of them.

12. After obtaining the statements, I booked in the seized brown wooden bat into police Nexus system to be forensically examined.
13. About 1:00am, Constable DEO and I attended 85 Malabar St, Fairfield to arrest the accused however we were unsuccessful.
14. We returned to our duties for the remainder of the shift and advised Fairfield Internal Supervisor of the outstanding arrest.

1. This statement made by me accurately sets out the evidence that | would be prepared, if
necessary, to give in court as a witness. The statement is true to the best of my knowledge and
belief and | make it knowing that, if it is tendered in evidence, | will be liable to prosecution if |
have wilfully stated in it anything that | know to be false, or do not believe to be true.
2. lam 55 years of age.
3. | have not used Generative Artificial Intelligence (Gen Al) in the creation of this statement or
any attached exhibits.
4. | currently reside at 51 Margaret Street Fairfield West with my 2 daughters being Kaity
ABSALOM and Rhianna ABSALOM. | reside at the front house and Kenneth MCMANUS being
my brother occasionally visits the rear granny flat.
5. Kenneth MCMANUS is my biological brother. My brother is diagnosed with paranoia,
schizophrenia and is described to be always aggressive and argumentative.
6. On Tuesday the 26` of August 2025 at around 4.00pm | was taken back to my home by police,
after drinking alcohol beverages with Kenneth MCMANUS at 85 Malabar Street Canley Vale.
7. | was then seated along my veranda at the front porch smoking a cigarette to where | heard the
front gate open. | then looked over the mesh and saw Kenneth MCMANUS walking towards the
garage door attempting to unlock it. During this time, | sat there quietly as | did not want to
converse with him or him to know | was there.

8. |then heard a loud smash on the garage door.
9. |then immediately proceeded to contact Dale SICILY being Kenneth’s roommate. Whilst on the
phone, | then walked towards the edge of the driveway and stood on the council footpath. | was
speaking to Dale SICILY and his partner Tanya saying:
| said: “Please hurry up, he’s going to turn, he is drunk again.”
They said: “stay on the phone, were on our way.”
10. A short time later | then saw their car pull up to the driveway. I`ve then seen Kenneth
MCMANUS walk towards the car. During this time Dale SICILY and Tanya got out of the
vehicle. Kenneth MCMANUS stumbled whilst walking to the car. | then tried to help him get up
immediately. He then used both his hands and grabbed me around the neck. | was having
slight trouble of breathing but was conscious the whole time. Dale SICILY and Tanya then
intervened and separated us both.
11. A short time later we had a group hug and tried to fix things. After having a group hug, Dale
SICILY walked away to have a smoke. During this time, Tanya opened the passenger door to
the truck and Told Kenneth come ‘on lets go.
12. A short time later | turned around to where | then was hit hard in the back of my head. | felt
immediate pain, shock and stumbled a bit. | then turned around and saw Kenneth MCMANUS
holding a wooden bat roughly 40-50cm in length.
13. I then tried to take the bat away from him by grabbing the bat directly and trying to yank it off
him. 1 was fearful that if | didn’t get that bat, he was going to kill me.
14. 1 then eventually took the bat off him and then took it straight inside the house. During this time
Dale SICILY and Tanya got Kenneth MCMANUS into the car and immediately drove away from
the location.
15. | then felt immediate pain and proceeded to call triple zero 000 requesting for police.
16. A short time later NSW Ambulance and NSW Police arrived and spoke to my daughters and |. |
was then taken to Liverpool hospital for treatment to my head.

17. Whilst at the hospital, the doctors clarified that there was bleeding, bruising and swelling around my head and hand.
18. On Tuesday the 2nd of September 2025, I attended Fairfield police station and provided police with a typed statement. I also provided police with medical records/discharge summary of my time at hospital.
19. I did not give anyone permission to hit me in the head. I have severe fears for my safety and the safety of my daughters and I believe Kenneth MCMANUS is violent and can cause us harm.

necessary, to give in court as a witness. The statement is true to the best of my knowledge and

4. |live at 51 Margaret St, Fairfield West with my mother Kayleen McMANUS and my older sister
Rhiannon ABSALOM. We have lived there for about a year and a half.
5. | was at home all day because | didn`t go to school. The whole day, my mum was a bit off
about her brother Kenneth McManus who is my uncle. He always acts weird because of his
mental health issues. He always creates drama or does something to piss my mum off.
6. About 11am, my mum came into my room and told me that Dale who is my uncles roommate
was going to come over to discuss what will happen with my uncle because Dale wanted to
move houses. He didn’t want to take Kenny with him but he didn’t want to leave him here
because he didn’t want him to harass my mum, sister and |.

My mum said she was going to go to Dale’s house with him to try sort out something with my
uncle. My mum messaged me about 4:00pm and said ill be home soon and that the police had
been called. She didn`t really tell me much just that Rhiannon was coming home early.
| called Rhiannon and asked what happened and she said she had to go pick up mum.
About 4:50pm mum came home with Rhiannon. Mum was really emotional. She was hard to
talk to. She was crying a lot and wouldn’t calm down. Normally when shes upset | try to make
sure shes okay, so | was giving her water.
Around 7:00pm, we started to cook dinner and | heard my mum outside on the phone to
someone. | then heard Dales truck. His Truck has a sound that you just know its that truck
because its very loud. My mum then came in and said Kenny was here. She said he was in the
flat. We just stayed inside and mum said Dale called the police.
My mum went back outside. Me and Rhiannon stayed inside. We heard yelling so we looked
outside to see what happened. | heard my mum say, “You`re my brother, why are you doing
this”. Something along the lines of that. | could just hear Kenny swearing. Eventually | heard
the truck leave. It was quiet so | assumed Kenny left too.
My mum came inside, and she was holding a bat in her hand. It was about 50cm long, brown,
wooden. She was crying and said something along the lines of “He hit me in the head with a
bat”. | was a bit confused because my mum told me Dale called the police so | thought they
would be here by now.
| was trying to keep my mum calm and gave her water. Me and Rhiannon then called police
and ambulance again. | took photos of my mum’s hand. | saw blood on her left hand. | asked
her what happened, but she said she didn’t know what happened.
About an hour later she said the blood might have come from when she was trying to get the
bat out of his hand.
Police and paramedics arrived not long after that. | spoke with Constable DEO and Constable
SIMONIAN and agreed to meet them at Fairfield Police Station to provide a statement.

7. My mum told me that police and ambulance were called because Kenny was very erratic and
had weapons but didn’t hurt anyone, and that the police told her she couldn`t drive home.
8. | got home at around 5:15pm. By the time | got home my mum had been dropped home by the
police but we still needed to go get her car. We left my sister at home then | drove mum to
Kenny and Dale’s. When we arrived, the ambulance was already there. Kenny was in the
ambulance and Dale was on the phone. Mum and Dale briefly spoke, and Dale told mum that
they would take Kenny to the hospital. Me and mum then got into the car and drove home.
9. We got home, went about our normal routine and then Kaity and | were inside. Mum was on
the veranda. Probably about an hour and a half to two hours later, Kaity and | were having
dinner and that`s when we heard voices outside. Because Kenny is always there, we didn’t
engage but | recognised that it was his voice. | then heard Dale`s truck because its very
distinct. Its like a vintage truck so it has a very loud engine. | then heard Dale’s voice. | didn`t
hear any yelling but | just heard them talking outside. Roughly 5 to 10 minutes later, mum came
inside and said “He’s hit me with a fucken bat”.
10. Mum was holding a bat, about 30cm in length, dark brown, wood, thick, smooth with some
cracks in it. | didn’t recognise the bat. | don’t know where it came from, but Kenny does often
come over with weapons.
11.1 then asked if she was okay, and Kaity checked mums head to see if there was any bleeding
or cuts which there weren`t. | then heard the truck leave and mum told us that Dale and Tania,
which is Dale’s girlfriend witnessed what happened and had taken Kenny home.
12. | asked what happened, she told us that she confronted Kenny for being at the house and
asked why he was there. He was then mouthing off, | don’t know what he had said. Then that
turned into the altercation of him hitting her. My mum said she doesn`t recall how the scratches
on her hand happened, but she remembers trying to get the bat back and hit Kenny`s knuckles
to try get the bat off her.
13. My mum told us she had called police and that she declined ambulance at the time. My mum
kept saying she was feeling very sleepy. She was lent over the table with her head on her
hands for about half an hour. Kaity and | kept asking if she was awake and trying to get her to

again to request police and ambulance.

15. When we moved to Maragret St, | raised some concerns with mum about Kenny. | have seen a
lot of violence from him. | told mum | was worried about our safety. | always wonder if he is
going to come in or try and break in or hurt mum because of previous incidents with Kenny and
my mum. My mum’s relationship has eased the concerns with Kenny however due to this
incident, these concerns are more real now.

# Defence Trial Preparation: Police v Kenneth William McManus
## 1. OPENING STATEMENT FOR THE DEFENCE
**May it please the Court,**
Your Honour, the defence case is straightforward: Kenneth McManus did not assault his sister. The evidence will show that on 26 August 2025, it was Kayleen McManus who was the aggressor, wielding a baseball bat against her brother who merely sought to protect himself.
The defence will establish through credible witness testimony that:
1. Mr McManus never struck his sister with the bat
2. Ms McManus was the one who retrieved the bat from the vehicle
3. Ms McManus struck Mr McManus multiple times while he shielded himself
4. Any physical contact by Mr McManus was purely defensive in nature
The prosecution bears the burden of proving beyond reasonable doubt that Mr McManus assaulted his sister and occasioned actual bodily harm. The evidence will demonstrate they cannot meet this burden.
## 2. NO-CASE SUBMISSION
**To be made at the close of the prosecution case:**
Your Honour, I submit there is no case to answer pursuant to section 93 of the Criminal Procedure Act 1986 (NSW) and the principles in *Doney v The Queen* (1990) 171 CLR 207.
The prosecution has failed to establish a prima facie case on the essential elements of the charge under s 59(1) of the Crimes Act 1900 (NSW), specifically:
1. **The assault element**: The prosecution evidence, taken at its highest, shows Ms McManus was the aggressor who retrieved and wielded the bat. The body-worn camera footage records Ms McManus stating she "dragged the bat off him" and "smashed his fingers with the bat."
2. **Causation of bodily harm**: The medical evidence shows no acute traumatic injury. The CT scans were clear. Any injuries were consistent with Ms McManus's own account of wrestling for the bat.
3. **Absence of lawful excuse**: Even accepting the prosecution case at its highest, Mr McManus was acting in self-defence when confronted by an armed aggressor.
The test is whether, taking the prosecution evidence at its highest, a reasonable jury properly instructed could convict. Here, they could not.

The agreed facts establish the background and undisputed matters. The facts in issue are clearly identified and narrow:

3. Whether the defendant acted in self-defence

**First**, Kayleen McManus was the aggressor. She retrieved the weapon, she wielded it, and she struck the defendant with it. Her own words on body-worn camera confirm this: "I dragged the bat off him" and "I smashed his fingers."
**Second**, the defendant never struck his sister. Two independent witnesses - Dale Sicily and Tanya - were present and confirm this. The medical evidence shows no traumatic injury consistent with being struck by a bat.
**Third**, any physical contact by the defendant was defensive in nature. When confronted by an armed aggressor, he was entitled to defend himself under s 418 of the Crimes Act.
**Fourth**, the prosecution's case relies entirely on the complainant whose credibility is undermined by:
